Hey TC,how did you manage to escape from the old folks home?

Seriously this post is just as important to the rest of us as these laws are or can be adopted by the rest of the world. It really makes my blood boil to hear and see the political machinations of the elected few as they jockey for power and glory. I mean the emissions of a few old earthmovers is hardly gonna affect the environment, why dont they stick to sorting out the trucks and cars? As has been stated many times before the real culprits for global warming are the airlines, with the height that airliners fly at the emissions stay suspended for long periods thus affecting the ozone layer.

Carb = calif air regularity board. All fed statutes are based on Calif. rules.

Here are the rules that my family's operation has to apply for:

Most of the title 5 rules get their power from the 1970, and 1990 Federal clean air act, just the state of CA enforces these rules where other sates CURRENTLY do not.


Carb does not make up the laws; they interpret, regulate and enforce the laws.

Federal statue always supercede a local or regional rule unless the lower ruling provides a tougher standard. For example state minimum wage can be higher than federal wage, but the state can not make it legal to pay less than the federal wage.

CARB is no different than the local sheriff enforcing a federal criminal law.

Carb has different regions that enforce the federal clean air act laws that limit federal highway dollars if that region does not meet the particulate standard.

There has been an instance recently where the emissions from a stationary engine are allowed under state of California but were denied under the limits imposed by the federal clean air act.

It’s easier for carb to enforce laws for:
Aftermarket car parts
Agriculture
Fuel production and handling
Forestry
Mining and Construction
Then go after pollution from cars and airplanes, because these laws affect a smaller population of voters then the above, and many of the above are larger companies where the employee does not see the impact.

We currently must apply for permits for,
AG conservation (management plan to reduce dust)
UN paved Roads, and parking lots
Stationary engines
Portable pumps
Livestock holding pins
Fuel storage tanks and loading rack
Fertilizer storage
Smog check on cars every other year, basically no car older than 10 -15 years will pass

Thanks for the correction, I suggest that they adopt my mistaken name though as they indeed regulate the use of air.:rolleyes:

Amazing though that China and Japan are so against any EPA actions and their out of control expansion polution is what is driving up the measuring devices in Washington State.

I feel so badly for anyone who has to operate a business in the CA state.

Al,
Its almost impossible to do business in CA. Thats why we don't any more. I work for someone else now, and let them have the headaches.
I thought that it was kind of ironic when I ordered some parts from Golden State Truck Parts, I found out that they had moved to Nevada.

When your tied to the land it's hard to move to Nevada, But companies such as light manufacturing and wherehousing have moved to Nevada due to more favorable laws and no inventory tax on wherehouse goods.


Even yesterday the Govenator had a summit on "global warming" with western state govenors, Nevada wasn't there.
